Landlord applied for MCI rent hikes based on the installation of a new roof and a fuel storage tank. The DRA ruled for landlord. Tenant appealed, claiming that landlord previously obtained an MCI rent hike for a new roof. The DHCR ruled against tenant. The DHCR approved the prior MCI rent hike for a new roof in 1988. This was based on a roof installation completed in 1982. The roof was replaced in 2003, more than 20 years later. So the useful life of the prior roof had expired.
