Landlord applied for MCI rent hikes based on the installation of a new boiler. The DRA ruled against landlord. Landlord appealed and lost. The DHCR's records showed that in 1987 the agency granted MCI rent hikes for installation of a new cast-iron boiler/burner and hot and cold water risers, returns, and branches. Under DHCR policy, a cast-iron boiler has a useful life of 35 years. Landlord therefore wasn't entitled to an MCI rent hike for a new boiler at this time because the new one was installed in 2001.
