Use of Indoor Garage Walkway Not Required

Landlord wished to restrict apartment complex garage entry to only those tenants who actually parked there. Landlord had permitted all tenants, whether garage space renters or not, to walk through the garage during bad weather. Landlord asked if changing this practice would be considered a reduction in required services. In an opinion letter, the DHCR said no. Permitting tenants to use the garage as an indoor walkway to reach a bus stop didn't rise to the level of a required service.

Landlord asked if changing this practice would be considered a reduction in required services. In an opinion letter, the DHCR said no. Permitting tenants to use the garage as an indoor walkway to reach a bus stop didn't rise to the level of a required service. It was instead an ''accommodation'' and could be discontinued without being considered a decease in required services.
