Unsafe Conditions in Boiler Room

DOB issued a violation notice to landlord for not maintaining the building in a safe condition and not keeping the boiler in good working order. The violation listed exposed wiring, a corroded boiler jacket, missing discharge pipes, debris and flammable materials in the boiler room, and holes in the boiler room walls. Landlord claimed that it had obtained a permit to convert the boiler from oil to gas before the violation was issued. The ALJ ruled for landlord and dismissed the violation.

Landlord claimed that it had obtained a permit to convert the boiler from oil to gas before the violation was issued. The ALJ ruled for landlord and dismissed the violation. DOB appealed, arguing that the permit alone didn't prove that landlord was maintaining the boiler room in a safe condition. ECB ruled for DOB and fined landlord $350. Landlord didn't dispute the conditions found in the boiler room by DOB's inspector. The boiler conversion hadn't taken place at the time of the violation, and there were unsafe conditions.
