Unkempt Yard

Tenant complained that the backyard behind the building was filthy and unkempt. An inspection showed that there were weeds and overgrown vegetation in the yard, which were visible from tenant's window. The DRA ruled for tenant and reduced her rent. Landlord appealed, claiming that failure to remove weeds in the backyard wasn't a decrease in service and was unrelated to tenant's apartment. The DHCR ruled against landlord. Whether or not tenant had access, she had an interest in seeing a properly maintained yard.
