Units Rented to Persons with AIDS

Landlord owned a rent-stabilized building where 60 percent of the units were occupied by persons with AIDS pursuant to a program run by NYC Human Resources Administration (HRA). Landlord asked the DHCR if these units are exempt from rent stabilization. In an opinion letter, the DHCR stated that these units may be exempt since the services are delivered for a charitable purpose and the building is operated primarily for this purpose. If HRA were to lease the units and then sublease them to persons with AIDS, the units would clearly qualify for an exemption.
