Landlord sued to evict loft tenant when tenant's lease expired. Tenant claimed that he was subject to loft law protection. The court ruled against tenant. When prior tenant died, prior landlord had filed an abandonment application with the Loft Board. The Loft Board had ruled for landlord and deregulated the loft. While the Loft Board case was pending, landlord had given current tenant a seven-year lease. But tenant was only a protected occupant until his lease expired.
