Uncovered Garbage Receptacles

The DOS issued a violation notice to landlord for having uncovered garbage receptacles in front of his building. Landlord argued that the garbage was in tied plastic bags, so it didn't matter if there were no garbage can lids. The ALJ ruled against landlord and fined him $100. Landlord appealed and lost. The inspector testified that there was exposed household garbage in the open cans, not just tied plastic bags. And the garbage receptacle covers were lying on the ground near the garbage cans.
