Uncovered Garbage Receptacle

DOS issued a violation notice to landlord for having an uncovered trash receptacle. Landlord objected, claiming that a tenant left the receptacle uncovered after a DOS pickup. The ALJ ruled against landlord and fined it $50. Landlord appealed, claiming that it should have a reasonable period of time to re-cover the receptacle after a trash pickup. ECB ruled against landlord. City rules require trash containers to be covered at all times. And landlord didn't even indicate the length of time that it claimed had elapsed between pickup and the issuance of the violation.
