DOS issued a violation notice to landlord for not cleaning 18 inches into the street. Landlord argued that the building was in a mixed commercial/residential area and that drug dealers created the litter. The ALJ ruled against landlord and fined him $50, saying that landlord was responsible for keeping the sidewalk clean. Landlord appealed, claiming that he swept the sidewalk twice a day, before and after going to work. ECB ruled for landlord and revoked the fine. Given the location of the building, landlord had made reasonable efforts to keep the sidewalk clean.
