Two Sweepings a Day Is Reasonable

DOS issued a violation notice to landlord for having a dirty sidewalk. Landlord claimed that it swept in front of the building twice a day. The ALJ ruled against landlord and fined it $50. Landlord appealed, explaining that the building was a small cooperative with no super. Residents swept twice a day, on a rotating schedule, in the morning and at 5:00 p.m. ECB ruled for landlord. Landlord showed that it made reasonable efforts to keep the sidewalk clean through its regular sweeping routine.
