Treble Damages Revoked for 31-Cent Overcharge

Tenant complained of a rent overcharge. The DRA ruled for tenant and found a total overcharge of $22.32, including triple damages. Landlord appealed, arguing that there was no willful overcharge. The DHCR ruled for landlord. The monthly overcharge found by the DRA was $0.31. This was mostly likely a clerical error and not a willful overcharge. The triple damages were revoked.
