TPU Found No Proof of Claimed IAIs

The DHCR’s Tenant Protection Unit (TPU) claimed that landlord overcharged tenant and later ruled that tenant’s monthly legal rent was $614 and that landlord must refund $80,713, including triple damages. Landlord appealed and lost. The TPU disallowed any individual apartment improvement (IAI) rent increase for the apartment after the DHCR’s inspector found that none of the claimed work had been done. The DRA gave the inspector a checklist of work claimed to have been done on landlord’s submitted invoice and the inspector found none of the items installed.

There also was a pre-base rent date rent reduction order in effect, which froze tenant’s rent.
