Too Many Violations Prevent MBR Increase

Landlord applied for 2004-05 MBR increases. The DRA ruled against landlord because the violation certification requirements were not met. Landlord appealed, claiming that the DRA was incorrect. The DHCR ruled against landlord. DHCR inspection found that two rent-impairing violations still existed. One was for a broken wash basin faucet in an apartment, and the other was a leaking roof. The existence of the rent-impairing violations barred the MBR increases.
