Tenant's Son Gets Rent-Stabilized Apartment

Rent-stabilized tenant's son complained that landlord refused to give him a renewal lease in his name after tenant moved out of the apartment. The DRA ruled for the son and ordered landlord to give him a renewal lease. Landlord appealed and lost. The son submitted sufficient proof that tenant vacated on May 24, 2010. The son also submitted tax returns for 2007 and 2008 that listed the apartment as the son's address, as well as a W-2 form for 2008. The son also submitted documentation of a bank account opened July 2008 listing the apartment as his address.

And landlord presented no evidence that the son had any other address during the two-year period before tenant moved out.
