Tenant's Sister to Pay Rent

Landlord sued to evict rent-controlled tenant for nonpayment of rent. The trial court ruled for landlord, and tenant was evicted. Tenant immediately asked to be restored to possession. The trial court ruled for tenant, and landlord appealed. The appeals court ruled against landlord. Tenant showed that at the time tenant was evicted, Protective Services for Adults was in the process of obtaining funds from tenant's sister. Tenant was prepared to pay all back rent when he appeared in court to ask to be restored to possession.
