Tenant's Leases Contained No Record of Preferential Rents

Rent-stabilized tenant complained of rent overcharge. The DRA ruled for tenant and ordered landlord to refund $8,224, including triple damages and excess security deposit. Landlord appealed and lost. Landlord claimed that tenant paid a preferential rent and that there was no overcharge. But the DRA examined tenant leases for the period between 2008 and 2016, including pre-base-date leases, and found no record of any preferential rent. These leases each listed only one rent amount.
