Tenant's Disabled Granddaughter Gets Apartment

LVT Number: #27412

Landlord sued to evict rent-stabilized tenant’s granddaughter after tenant died. Landlord claimed that the granddaughter was a licensee, but the granddaughter claimed that she had succession rights. The court ruled for the granddaughter who proved that she was disabled and that she had lived with tenant for at least one year before tenant died. The granddaughter had been declared disabled by the Social Security Administration in 1995 due to asthma and a personality disorder, and her ability to work was limited as a result.
