Six tenants in landlord's building filed separate applications, asking the DHCR to determine if they were rent stabilized. The DRA ruled for tenants, finding that each had been improperly deregulated.

Landlord appealed and lost. Tenants all lived in the building while landlord received J-51 tax benefits, which expired in 2009. Landlord claimed that any rent stabilization status expired when the J-51 tax benefits ended. But each of the tenants showed that they didn't receive J-51 lease riders advising them of the effect and expiration date of J-51 coverage. The law required landlord to provide J-51 riders with each of tenants' leases, or else they remained rent stabilized until they moved out.
