Tenant's Conduct Didn't Amount to Nuisance

Landlord sued to evict rent-stabilized tenant for nuisance. The court ruled against landlord, and landlord appealed. The appeals court again ruled against landlord. The court fairly interpreted the proof presented and properly found that tenant's conduct didn't threaten the comfort and safety of other building occupants. So the appeals court had no reason to rule otherwise.
