Tenant's Complaint Dismissed Because Building Not Rent Stabilized

Tenant complained to the DHCR of a reduction in services. The DRA dismissed the complaint, finding that tenant's building wasn't subject to rent stabilization. Tenant appealed and lost. DHCR records showed that the building had no history of regulation or registration. Landlord pointed out that the building was being used as emergency housing for homeless persons and would otherwise be exempt from rent stabilization due to a prior substantial rehabilitation.
