Tenants Can't Vacate Default

LVT Number: 12875

Landlord sued to evict tenants from several rent-stabilized apartments. The court ruled for landlord based on tenants' failure to appear in court. Tenants later asked the court to vacate the default judgments. The court ruled against tenants, and tenants appealed. The appeals court also ruled against tenants. There was no valid defense to the eviction actions. Although tenants now claimed to hold rent-stabilized leases to the apartments, the bankruptcy court had already ruled that these leases were fraudulent.
