Tenant's Belongings Damaged During Weatherproofing

Tenant appealed, claiming that several of the defective conditions weren't included in the order directing restoration of services. Tenant's personal belongings had been damaged during building weatherproofing. The DHCR ruled against tenant.

Tenant's personal belongings had been damaged during building weatherproofing. The DHCR ruled against tenant. The replacement of tenant's outdoor plants and the cleaning of tenant's indoor carpeting and furniture weren't required services, and landlord's failure to perform these services wasn't the basis for a rent reduction. If tenant wanted relief from landlord, she must start a court case.
