Tenant's Apartment Used for Illegal Purpose

LVT Number: 14419

Landlord sued to evict tenant for drug activity in her apartment. The court ruled for landlord. Tenant appealed and lost. Landlord proved at the trial that police had entered tenant's apartment with a search warrant and recovered a pail containing over a pound of cocaine, a scale, drug paraphernalia, ledger books, radio transceivers, and $6,700 in cash. Tenant claimed that her boarder was involved and she didn't know about the drug activity. This wasn't believable, since the drugs were in plain view and tenant's prior boarder had also been arrested on similar drug-related charges.
