Tenant's Apartment Reconfigured

Landlord applied for MCI rent hikes based on the installation of a parapet and new roof. The DRA ruled for landlord, and tenant appealed. Tenant claimed that the room count listed for his apartment on landlord's application was incorrect. Landlord listed five rooms, but tenant claimed there were only three or four. The DHCR ruled for tenant. Landlord claimed that tenant altered his apartment without permission, creating five rooms. Tenant claimed that the alteration was done with prior landlord's approval. Also, other apartments in the same line had four rooms.
