Landlord applied for MCI rent hikes based on the installation of new thermal windows on a building-wide basis. The DRA ruled for landlord except that three apartments were exempted from the rent increases because the windows in these apartments required repairs. Landlord appealed, pointing out that it had submitted to the DRA work tickets signed by tenants in at least two cases and showing that the repairs had been made. The DHCR ruled for landlord. Landlord had submitted proof that the repairs were made and tenants filed no contrary answer to landlord's PAR.
