Tenant Wouldn't Allow Access on Weekdays

The DRA reduced tenant's rent, based on a reduction in services. Landlord later asked the DRA to restore tenant's rent. Landlord couldn't complete the repairs because tenant wouldn't give landlord access. The DRA ruled for landlord and restored tenant's rent. Tenant appealed. The DHCR's records showed that an inspector went with landlord and landlord's workers to tenant's apartment on an agreed-upon date so that landlord's workers could make repairs. This was the second date set by the DHCR for inspection and access; tenant said she couldn't be home on the first date.

When landlord and the inspector went to tenant's apartment, she wouldn't let the workers do repairs, and insisted that they come back on a Saturday. Tenant was also verbally abusive to the inspector. The DHCR ruled against tenant. Tenant's refusal to let landlord make repairs during business hours between Monday and Friday was unreasonable.
