Tenant Withdrew Complaint

Tenant complained of reduced services. He claimed that the walls and ceilings throughout the apartment were peeling and cracking, that the venetian blinds were defective, and that the kitchen linoleum was cracked. Landlord argued that tenant didn't pay rent, and that a court case was pending to decide on tenant's right to live in apartment. An inspection confirmed tenant's complaints, and the DRA cut tenant's rent. Landlord appealed, arguing that tenant had agreed to withdraw his DHCR complaint after reaching a settlement with landlord in the pending court case.
