Tenant Withdrew Complaint

Tenant complained of a lack of heat and hot water. The DRA ruled for tenant based on HPD violation reports and reduced his rent. Landlord appealed. The HPD violation was issued in January 2003, and landlord didn't get tenant's complaint until February 2003. By that time, the condition had been corrected. In addition, tenant admitted that shortly after the DRA order was issued, she agreed in a housing court settlement agreement to withdraw her rent reduction complaint. The DHCR ruled for landlord based on tenant's withdrawal of her complaint.
