Tenant Who Threatened Other Tenants Can Be Evicted

Landlord sued to evict rent-stabilized tenant for creating a nuisance by threatening and harassing at least 13 other building tenants. Tenant claimed that she was being harassed by the other tenants and felt unsafe in the building. She said she complained to the DHCR, which instructed her to record incidents of harassment. Therefore, she began filming other tenants in the building. After trial, the court ruled for landlord. Credible witnesses testified that tenant followed tenants and their children with a camera phone, yelling at and threatening them, including with racial slurs.

Tenant could be evicted and wasn't entitled to a post-judgment cure of this behavior.
