Tenant Who Moved in After Building's Condo Conversion Wasn't Rent Stabilized

Tenant complained to the DHCR of rent overcharge and improper deregulation. The DRA ruled against tenant, who appealed and lost. The building was converted to a condominium in 1987. The tenant moved into the apartment in 2021, after the condo conversion and the unit therefore was exempt from rent stabilization. The apartment was occupied by a rent-stabilized tenant at the time the building was converted and the unit remained unsold for some time. But tenant wasn't a "non-purchasing tenant" as defined by GBL Section 252-eee(1)(e). Once the prior rent-stabilized tenant moved out, the unit lost its rent-regulated status.
