Tenant Violated Settlement Agreement Three Times

Landlord sued to evict tenant in 2015 for chronic nonpayment of rent. Landlord claimed that it commenced 16 separate nonpayment proceedings against tenant since 2002. Landlord and tenant signed a settlement agreement in court, placing tenant on probation and requiring timely payment of rent going forward. After that, the court twice granted tenant’s requests to excuse breaches of the agreement. But the court denied tenant a third chance to extend time to pay overdue rent and restore him to a probationary period.
