Tenant Unlawfully Evicted

Occupant sued landlord, claiming unlawful eviction. He had moved into the apartment with tenant in 1988. In June 1995, landlord changed tenant's apartment door lock, had occupant arrested and put in jail for breaking into the apartment after the lock was changed, and threatened to take tenant's things out of the apartment. The court ruled for occupant and tenant and ordered landlord to let them move back in. Landlord had met occupant on a number of occasions and knew that he'd lived there for a number of years.

The court noted that occupant may also have grounds to sue landlord for triple damages in light of the improper arrest and jailing.
