Tenant Threatened and Verbally Abused Neighbors

Landlord sued to evict tenant for creating a nuisance. Landlord said that tenant let her pets defecate on the building roof; fed pigeons there, resulting in a building violation; and harassed and threatened her neighbors through threats, confrontation and undue noise. Landlord and tenant signed a settlement agreement in court. Tenant agreed not to harass her neighbors. If she did so during the next 15 months, landlord could come back to court for a hearing on whether tenant's behavior continued. Landlord later returned to court for a hearing.

Several other tenants testified that tenant threw eggs and mud at their apartment doors, yelled at them, threatened to kill them, pushed one tenant down, continued to feed pigeons, poured water out her window, and banged on her apartment floor. Witnesses that tenant called on her behalf also testified that tenant was easily angered. The court ruled for landlord. Landlord proved that tenant's behavior threatened the comfort, safety, and right to quiet enjoyment of other building tenants.
