Tenant Sold Drugs from Apartment

LVT Number: 10603

Landlord sued to evict tenant for selling illegal drugs from her apartment. Tenant claimed her husband was selling the drugs and that she had no knowledge of it. The court ruled for landlord, and tenant appealed. The appeals court ruled against tenant. When police searched the apartment with a warrant, they found 130 vials of crack cocaine and various measuring and packing materials in different parts of the apartment. Tenant had access to all areas of the apartment and, given the large amount of drug paraphernalia recovered, the jury reasonably found that her claim wasn't believable.
