Tenant Signed Lease After Co-op Conversion

LVT Number: 16152

Landlord cooperative apartment owner sued to evict tenant after tenant's lease expired. Tenant claimed that she was entitled to a renewal lease under provisions of the General Business Law relating to cooperative conversions. The court ruled for landlord. Tenant appealed and lost. The building converted to a co-op in 1971. Tenant's 1992 lease wasn't protected by the General Business Law because it was signed after the building converted to a co-op. Notably, prior tenant's 1977 lease also indicated that the apartment was decontrolled.
