Tenant Scatter Site Program Fails to Prove Grounds for Eviction of Program Participant

Tenant (HCCI) was a scatter site housing program that claimed to have an agreement with the NY Human Resources Administration (HRA) to house participants in HCCI's program. HCCI provided housing to its subtenant participant at landlord's building as part of its scatter site program. HCCI said it followed HRA's procedure for terminating subtenant from the scatter site housing program, then sued to evict subtenant from the apartment, claiming she no longer was a participant. The court ruled against tenant.

Tenant (HCCI) was a scatter site housing program that claimed to have an agreement with the NY Human Resources Administration (HRA) to house participants in HCCI's program. HCCI provided housing to its subtenant participant at landlord's building as part of its scatter site program. HCCI said it followed HRA's procedure for terminating subtenant from the scatter site housing program, then sued to evict subtenant from the apartment, claiming she no longer was a participant. The court ruled against tenant. HCCI failed to present adequate testimonial and documentary proof that subtenant's right to possession of the apartment was subject to her participation in the HCCI scatter site housing program, that HCCI and HRA had an agreement to provide services for housing participants, that HCCI followed the HRA procedure for terminating the subtenant from the program, or that subtenant failed to follow the rules and regulations of the program.
