Tenant’s Daughter and Granddaughter Both Have Succession Rights

Landlord gave rent-stabilized tenant’s daughter a vacancy lease when tenant died. The daughter then complained of rent overcharge. She claimed that she and her daughter, who was the original tenant’s granddaughter, both had succession rights and should have received a renewal lease. The DRA ruled for tenant. Landlord appealed and lost.

Landlord gave rent-stabilized tenant’s daughter a vacancy lease when tenant died. The daughter then complained of rent overcharge. She claimed that she and her daughter, who was the original tenant’s granddaughter, both had succession rights and should have received a renewal lease. The DRA ruled for tenant. Landlord appealed and lost. The daughter and granddaughter showed that they moved in with prior tenant in 2006 and that prior tenant left the apartment due to illness in 2011. When prior tenant’s last renewal lease expired in 2013, they both requested a renewal lease in their names. Since both the daughter and granddaughter had lived with tenant for more than two years, they were entitled to a renewal lease in both their names.
