Tenant Relocating to New Apartment

Landlord asked the DHCR what the legal rent was if it relocated rent-stabilized tenant to a new apartment. In an opinion letter the DHCR stated that if tenant agreed to move from one rent-regulated apartment to another for landlord's convenience, then the apartment into which tenant moves retains the rent-controlled or rent-stabilized status of the apartment from which tenant was moved. Landlord could charge tenant no more than the lawful rent for the apartment into which tenant relocated.
