Tenant Overcharged Roommate

Rent-stabilized tenant's roommate complained of a rent overcharge. The DRA ruled for the roommate and ordered tenant to refund $8,865. Tenant appealed and won, in part. The roommate claimed that most months he paid $700 to tenant, more than double his proportionate share of the legal rent. The DHCR held a hearing. The roommate first moved into the apartment as tenant's boyfriend. Tenant claimed that he initially agreed to pay for food each month. This wasn't credible, but the roommate could prove only that he paid $350 per month. The total overcharge was substantially reduced.
