Tenant Not Entitled to SCRIE Benefits

(Decision submitted by Joseph Burden of the Manhattan law firm of Belkin Burden Wenig & Goldman, attorneys for the landlord.) Landlord asked the Department for the Aging (DFTA) to revoke tenant's SCRIE benefits after discovering that tenant used her apartment as a boarding house and didn't report the substantial income to the city. DFTA ruled against tenant, finding that she committed fraud. Tenant's benefits were retroactively reduced and tenant was ordered to pay back over $75,000 plus interest.
