Tenant Never Moved Out, Can Resume Adding Name to Renewal Lease

Rent-stabilized tenant moved into the apartment in 1979. He remained in the apartment, but landlord later issued renewal leases to tenant’s common-law wife. Tenant later complained that landlord refused to list him on recent renewal leases. The DRA ruled for tenant and ordered landlord to add him to the latest renewal lease. Landlord appealed and lost. There was no proof that tenant ever surrendered his tenancy. So he was entitled to have his name included on the renewal lease.
