Tenant Must Remove Storage Shed

LVT Number: 10735

Tenant complained of a reduction in services because landlord forced her to remove a storage shed from the building's basement. The DRA ruled for tenant, and landlord appealed. Landlord pointed out that the storage shed had belonged to tenant's grandmother, who lived in the apartment until her death. Tenant argued that she herself had lived in the apartment for 20 years and had shared the expense of the storage shed with her grandmother. The DHCR ruled against tenant. Tenant's grandmother had use of a storage shed in the basement.

Tenant's grandmother had use of a storage shed in the basement. While tenant may have had use of the shed with permission from her grandmother, no additional storage space was given to tenant and storage wasn't a service associated with tenant's apartment from the time that she moved in.
