Tenant Must Pay Rent Due

Landlord sued to evict tenant for nonpayment of rent. The court ruled for tenant, and tenant appealed. Tenant claimed landlord waited too long before asking for the rent due. The court ruled against tenant. Tenant was unquestionably in arrears. There was no purposeful delay on landlord's part to make excessive arrears accumulate. In fact there were extensive settlement negotiations to try to work out a reasonable payout schedule.
