Tenant Must Pay Interim Rent into Court

LVT Number: 10277

Landlord sued to evict tenant for nonpayment of rent in 1989. The court case continued for two years before a decision was issued. In the meantime, the court ordered tenant to pay rent into court. Tenant appealed, claiming this was an abuse of the court's discretion. The appeals court ruled against tenant. Given the length of time it took the case to be resolved, it was reasonable to order to pay interim rent into court.
