Tenant Lost Gas Service Due to Gas Leak Shut-Off

Rent-stabilized tenant complained of a reduction in services in May 2012 after cooking gas was shut off to her apartment. Landlord didn't answer the complaint. The DRA ruled for tenant in October 2012 and reduced her rent. Landlord appealed and lost. Tenant claimed that the gas to her stove was shut off between February and September 2012. When the gas was restored, her stove no longer worked, and landlord replaced it in November 2012.  Landlord claimed in its PAR that the gas line was replaced to remedy a gas leak and that DOB took a long time to approve the blue card.

DOB signed off on the replacement on Sept. 25, 2012. But the DHCR couldn't consider new evidence on appeal and, at the time of the DRA's inspection, the gas line in the basement was red-tagged by Con Edison.
