Tenant with Life in 'Chaos' Excused for Not Answering Deregulation Notice

LVT Number: #29842

Landlord applied for high-rent/high-income deregulation of tenant's rent-stabilized apartment in 2015. The DRA ruled for landlord based on tenant's failure to respond to the DRA's notice of the application and failed to provide required income verification information. Tenant appealed, and the case was reopened. Tenant argued that her household income was below the annual deregulation threshold in both 2013 and 2014.

The DRA ruled for landlord based on tenant's failure to respond to the DRA's notice of the application and failed to provide required income verification information. Tenant appealed, and the case was reopened. Tenant argued that her household income was below the annual deregulation threshold in both 2013 and 2014. Tenant also said that her life "was in utter turmoil and chaos" when she received the DHCR notices and that she was unable to respond due to health problems of herself, her daughter, and her mother. Tenant submitted medical documentation supporting her claim. The DHCR determined that tenant showed good cause for her default and sent the case back to the DRA to decide the matter on the merits.
