Tenant Got Notice of Inspections

The DRA ruled for landlord based on tenant's failure to provide access for a DHCR inspection. Tenant appealed, claiming that she didn't get notice of the inspections because they were addressed to her husband, who had moved out two years earlier. She also said she was out of state at the time of the inspections, because of a family emergency. The DHCR ruled against tenant.

The DRA sent the inspection notices to tenant at the apartment and to husband at an alternate address. Tenant received the first notice and asked to reschedule because of a family emergency. Tenant also received other correspondence from the DHCR at the apartment. The second inspection was scheduled for two months later. It was tenant's responsibility to provide access.
