Tenant Gets Fees for Pass-On Case

LVT Number: 14696

Landlord sued to evict apartment occupant after rent-stabilized tenant moved out. The court found that occupant was entitled to pass-on rights. Almost two years later, tenant asked the court for attorney's fees. The court ruled against tenant because the case had been off the calendar for so long. Tenant appealed and won. Tenant had claimed the right to attorney's fees in its court papers, so it wasn't a surprise when he asked for them.
