Tenant Filed Complaint About Specific Item

LVT Number: 18038

Tenant complained of a rent overcharge. He said that landlord improperly charged him $37.50 for the cost of replacing a broken shower handle. Landlord answered that tenant hadn't paid this charge and landlord had removed it from tenant's rent bill. The DRA found that the issue was resolved, but found a rent overcharge. Landlord claimed that tenant paid a preferential rent, but landlord hadn't submitted copies of leases and riders from the base date as requested. Landlord appealed, pointing out that tenant only filed a specific rent overcharge complaint about the shower handle charge.

Tenant's complaint wasn't about a general rent overcharge. The DRA's review should have been limited to determining only tenant's claim.
